A formal request was made for recertification pending a hearing. A formal request was made for renewal certification of all motors affected by this arbitrary decertification. All contacts were refused or ignored. U.S. Rockets works with other companies in motor manufacturing and all of these other companies received similar treatment. No progress has been made despite constant effort by U.S. Rockets during this time period. During this time period another manufacturer (Kosdon Enterprises, Ventura, CA) who never received a manufacturing permit has remained on the certified list despite TMT rules specifically stating, "The applicant must also provide TMT with a copy of a BATF Low Explosive Manufacturer's license prior to acceptance of motors for testing. This requirement is by Tripoli Board motion and vote on 23 January 1994." That manufacturer's facility is in the kitchen and garage of a residential home in a populated suburb where he has been officially notified his activities are illegal and in violation of building codes. TRA is aware of all these facts. In addition Kosdon has a written non-compete contract with USR it has violated, also a fact TRA is aware of and continues to allow the motors to be represented as certified, in some cases as in a post-certification period, and in some cases as commercial EX (experimental) motors.
